In a significant move for New Jersey’s cannabis industry, the state’s Cannabis Regulatory Commission (CRC) approved an increase in the social equity fee and launched the long-awaited application process for cannabis consumption lounges. These decisions mark pivotal steps in advancing equity programs and addressing accessibility challenges within the industry.
Social Equity Fee: Incremental Increase
The CRC approved a hike in the social equity fee from $1.24 to $2.50 per ounce, effective January 1, 2025. This fee, paid by cannabis cultivators, funds programs aimed at reinvesting in communities disproportionately affected by marijuana criminalization and initiatives to prevent youth cannabis use.
- Revenue Impact: In fiscal year 2024, the fee generated approximately $2.6 million, although none of these funds have yet been utilized.
- Advocacy for Higher Fees: Progressive groups, including the ACLU of New Jersey, pushed for the legal maximum fee of $30 per ounce. However, some CRC commissioners, citing potential economic harm to businesses, opted for a more conservative increase.

Consumption Lounge Applications Open
The CRC also announced the long-awaited application process for cannabis consumption lounges, set to begin in 2025.
Key Application Dates and Details:
- Social Equity Businesses: Applications open January 2, exclusively for businesses from New Jersey’s 55 economically disadvantaged areas.
- Diversely Owned Businesses: Applications open April 2 for minority-, woman-, and disabled veteran-owned businesses.
- General Applications: Available starting July 2.
Licensing Costs:
- Microbusinesses: $1,000 application fee.
- Standard Dispensaries: $5,000 application fee.
Lounge Guidelines:
- Lounges must adhere to strict regulations, mirroring the rules for alcohol-serving establishments.
- Consumption is restricted to on-site; unconsumed cannabis cannot be removed from the premises.
- Lounges can be located within dispensaries, subject to municipal approval.
Despite legalization in 2022, New Jersey lacks public consumption spaces outside private residences. The introduction of lounges aims to address this gap, though municipalities retain the power to limit their number.
Mixed Reactions from Business Owners
Many in the cannabis industry have expressed frustration over the delayed application process, which was initially announced nearly a year ago.
“Business owners have found loopholes to host events in the absence of formal guidelines, but a structured process is long overdue,” noted an industry observer.
Chairwoman Dianna Houenou assured applicants that a standardized form would simplify municipal approvals, alongside requirements for floor plans, ADA compliance, and operational procedures.
